Power to Decide Statement on Supreme Court Decision Maintaining Access to Mifepristone for Now

(WASHINGTON, D.C.) — Today, the U.S. Supreme Court granted a stay in Louisiana v. FDA, reversing an order from the Fifth Circuit imposing dispensing restrictions on mifepristone, a safe and effective medication for miscarriage and abortion care. This means that people will continue to be able to get mifepristone by mail or at their local pharmacy.

In response, Power to Decide Interim Co-CEO and Vice President, Policy and Strategic Partnerships, Rachel Fey, issued the following statement: 

“This ruling is a temporary relief for abortion seekers, but literally the bare minimum this court should do. Overwhelming scientific evidence shows mifepristone is safe and effective, including when dispensed by mail or at a local pharmacy.

“Restricting access does not eliminate the need for care—it only creates unnecessary barriers, delays, and inequities. This is particularly true for Black, Indigenous, and other communities of color; people living in rural areas; survivors of intimate partner violence; people with disabilities; and people with low incomes—all of whom struggle even more to access abortion care in the post-Dobbs landscape.

“This is far from the end of this struggle. We know that this decision is not the final word in the case, nor is it the end of abortion opponents’ efforts to ban abortion nationwide.
